I do not mean to scare you, but I think the time period between 10-Oct-2009 and 13-Jan-2010 would be considered unlawful presence.
Also, I don't know how a new I-94 would be work out once you are considered "unlawfully" present. i.e. Since your "new" I-94 is naturally after your "unlawful" presence, I don't know if it is considered valid....Do you have to re-entry for it to be valid OR would it be considered valid while you remain here?
Also, when was your last (re)entry into US?
This is just my opinion.
But I would seriously recommend you consult with a reputable attorney ASAP, as it might affect your current and future employment and/or green cards.

Probably not. However, one could potentially wait to get RFE or NOID and hope that PD is current at that time.

The 32 million will get insurance coverage only from 2014 from a govt created pool of private insurance companies, since the govt will subsidize 60% of that amount, dont think that the insurance will get much money from the govt.
Moreover when these companies have to accomodate pre existing conditions , a person can get insurance before going to see a doctor.So essentially the patient can rake a 20k bill to the insurance comp just by paying premiuim for that year.Just imagine if a company pays more to doctors than it gets from people???it will fall.
If a person can get insurance across state lines our insurance prem wud be lower and more ppl wud buy it instead of forcing people to buy from 2014.
why is the insurance premiums going to rise after healthcare bill is passed???
The main idea of the Obama plan is to bring the insurance companies down slowly and to create a govt single payer system.
oh ya.... if this bill will crumble insurance companies then y is it that their stock is going up for last 3 days..... insurance companies got a sweet deal.... another 32 million customer..... & u r saying they r going broke by getting more business.... that's expensive....

You need to wait at least 180 days after I-485 receipt date, then you can port your I-140. You are not required to do anything to use AC21 (notifying the USCIS is not necessary), but you have to make sure the new job has the same or similar occupational code (SOC) (you can find it in LC). I ported twice with no issues, no RFE and received my GC.

Interfile was submitted early June.
RFE for medical received end of June.
RFE replied July 3rd week.
Constant LUDs for 5 days after that.

My attorney specifically said we can't apply AP for a person when that person is abroad.
My attorney also said we can't mail an approved AP for a person when that person is abroad although the AP was applied while that person was in US.
Advance parole is an advance permission to travel. It needs to be obtained before your travel and one should return before it expires. Traveling first and then applying for permission to travel beats the intent.
Since you are planning in September, apply for an AP, get it approved and then travel. Money spent is like an insurance to avoid the headaches that follows if there are issues.

Why is everyone worried when USCIS is now following the law. It is hypocritical to think that all laws that favor me should be followed and USCIS should ignore all enforcement rules. We want USCIS to follow the law and not waste visas. But we want USCIS not follow the law in certain places.

I would like to make a request to IV core members, it seems $50 re-occurring contribution is little tough on some us as most of us are on H1 and are with single income and some of us may also have parents & younger siblings to support in India, pls give us an option to have $20/- minimum and members have option to go up as per there choice if they can afford.

I have applied for I 140 in July 2007 and my case is pending from more than 2 years(Labor substitution). I have changed from regular to premium processing last week and from past 3 days I am getting different update on my case.
I thought that day # 2 status is maintained by USCIS until we respond to RFC. Why did my case status change to "case received and pending" after RFC?. Can any one please explain.
It is really strange that everyday I am getting different updates... Please find the details below:
1) On 07/28/2009 I got following email stating
Current Status: Request for Premium Processing
Your Request for Premium Processing Service for your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received on July 28, 2009. We mailed you a receipt with information about processing.
